Remodeling in Belvedere? Check the Permit Clock Before You Buy or Sell

Two dwarf olive trees beside a Golden Gate Avenue driveway became an unlikely part of a costly construction dispute.

According to The Ark, the trees were planted in 72-inch boxes rather than the approved 36-inch boxes. They became central to a four-year legal fight over a $300,000 construction time-limit penalty. Belvedere ultimately settled the penalty for $100,000, with the money allocated to parks and open spaces. Read The Ark’s reporting.

For buyers and sellers, the practical lesson is straightforward: a renovation’s permit deadline deserves attention alongside its budget and scope.

Which construction deadlines apply?

Belvedere’s construction time limits cover projects requiring design review, building-permit projects valued at $50,000 or more, and qualifying landscaping projects associated with a building permit.

The city’s schedule links the completion period to the estimated project value:

Estimated project value

Construction time limit

Up to $100,000

6 months

$100,001–$500,000

12 months

$500,001–$2 million

18 months

More than $2 million

24 months

Completion also requires the applicable agency approvals. A project that looks finished may still need final sign-offs. Confirm those requirements early and include them in the construction schedule. Belvedere’s construction time-limit ordinance

What happens when a project runs late?

For permits issued on or after June 13, 2024, the city’s fee schedule lists escalating extension charges.

The Building Official may grant a completion extension of up to 30 days before expiration for a project in good standing. That decision considers whether work started promptly and continued regularly.

Otherwise, expiration triggers a Stop Work Order. The first reactivation costs the original project construction permit fee and provides one-third of the original construction period. The second costs three times that fee for another third of the original period.

A further reactivation requires City Council involvement, additional conditions and a charge of up to five times the original fee. It is not an automatic extension.

Permitted work generally runs from 8 a.m. to 5 p.m. on weekdays, excluding city holidays, with limited exceptions. Those restrictions belong in the schedule too. Permit expiration, extensions and working hours

How much could an extension cost?

Older permits need a separate review

Do not assume the current extension structure applies to an older project.

The city’s fee schedule treats permits issued before June 13, 2024 separately. Recent disputes show why checking the permit’s history matters: The Ark reported that the council reduced another Golden Gate Avenue homeowner’s construction penalty from $698,400 to $339,600 in February 2026. Selling with unfinished work

Belvedere’s Residential Building Records Report, commonly called the RBR, includes expiration dates for permits covering unfinished work, insofar as that information is available. It can also identify hazards and code violations requiring remediation.

The published code allows the city 30 days to issue the report after receiving a complete application. The report is valid for up to 12 months and must reach the buyer before escrow closes. Residential building report requirements

Order it early. The city’s application instructs owners to obtain it before offering the property for sale and requires a current Sanitary District No. 5 Notice of Compliance or Non-Compliance. Confirm current submission requirements with city staff. City application

Before committing to the next step

For a home with unfinished construction, request the permit record, approved plans, inspection history and any extension or enforcement notices. Confirm the current deadline and remaining approvals directly with the city.

Buyers and sellers should also resolve who will complete the work and pay any associated charges. Do not assume a sale resets the construction clock.

Whether you are planning a remodel or preparing a property for sale, establish the permit timeline early. It belongs in the budget, the contractor’s schedule and the transaction planning.
